Searches Relating to Third Parties

Legal Disclaimer and User Certification

The deleteme platform and its related search, digital-footprint, cybersecurity, and intelligence services (“Services”) are intended exclusively for lawful, legitimate, and authorized purposes. The Services must not be used to unlawfully investigate, monitor, profile, identify, locate, contact, threaten, discriminate against or otherwise interfere with any third party.

 

By submitting a search concerning another individual or organization, you represent, warrant and certify that:

 

  1. Lawful purpose and authority. You have a specific, legitimate and lawful purpose for the search and all necessary consent, authority, contractual rights or other valid legal basis required in every applicable jurisdiction.

  2. Data-protection compliance. You are independently responsible for complying with all applicable privacy, data-protection, cybersecurity, surveillance, employment, consumer-reporting, anti-discrimination and criminal laws, including, where applicable, the EU GDPR, UK GDPR, national implementing legislation, U.S. federal and state privacy laws, and equivalent international requirements.

  3. Prohibited purposes. You will not use the Services for stalking, harassment, intimidation, blackmail, doxxing, identity theft, impersonation, fraud, unlawful surveillance, unauthorized access, discrimination, retaliation, locating protected persons, exploiting credentials, or any other unlawful or harmful activity.

  4. No consumer-reporting use. Unless expressly agreed by deleteme in a separate written contract, the Services and reports are not “consumer reports,” and deleteme does not act as a “consumer reporting agency” under the U.S. Fair Credit Reporting Act (“FCRA”). You must not use the Services, in whole or in part, to determine any person’s eligibility for employment, promotion, credit, lending, insurance, housing, tenancy, education, government benefits, licensing or any other purpose regulated by the FCRA or similar legislation.   5. Sensitive information. You will not search for, process, disclose or use sensitive personal data, special-category data, biometric data, health information, information concerning children, criminal-offense information or confidential communications unless expressly permitted by law and supported by all necessary legal conditions and safeguards. Under European data-protection law, information obtained from publicly accessible sources remains protected personal data and requires a lawful basis for processing. EU GDPR

  6. No unauthorized access. You must not use any information supplied through the Services—including usernames, passwords, access tokens, contact details, or technical information —to access any account, device, system, database, or communication without the owner’s express lawful authorization. Unauthorized access may constitute a civil or criminal offense, including under the U.S. Computer Fraud and Abuse Act and Stored Communications Act. 18 U.S.C. §1030 and 18 U.S.C. §2701

  7. Verification required. Search results may be incomplete, outdated, inaccurate, duplicated, or connected to a different person or organization with similar identifying information. Results may include allegations, opinions, archived material or information obtained from third-party sources that deleteme has not independently verified. You must independently verify all material information before relying on it or taking any action.

  8. No automated or adverse decisions. You must not use search results as the sole basis for legal, financial, reputational, disciplinary, employment, housing, credit or other decisions affecting a person’s rights or interests. Qualified legal review, independent verification and appropriate human assessment are required.

  9. User responsibility. You are solely responsible for your searches and for collecting, storing, using, sharing, exporting, publishing or otherwise processing the results. deleteme does not approve, endorse or assume responsibility for your purpose merely because the platform permits a search to be submitted.

  10. Monitoring and enforcement. deleteme may request evidence of your identity, authority, consent or lawful purpose; restrict results; suspend or terminate access; preserve relevant records; and report suspected unlawful conduct to competent authorities where permitted or required by law.

  11. Indemnification. To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless deleteme, its affiliated companies, directors, officers, employees, contractors and data providers from claims, investigations, penalties, losses, liabilities, damages and reasonable legal costs arising from your searches, your use or disclosure of results, your breach of these terms, or your violation of any law or third-party right.

  12. No waiver of mandatory rights. Nothing in this disclaimer excludes liability or limits rights where doing so is prohibited by applicable law. If you cannot truthfully provide these certifications, you must not search.
